Due to being totally destroyed by my divorce,(and infidelity by my wife) I was mentally unable to work and to pay court ordered support... I even became homeless. After 3 years I got back on my feet but had to plead guilty to contempt of court.
Now to my real problem...
3 years of not paying support comes to about $25,000. I don't mind having to pay that back, but with interest its now almost $50.000 ! Every month I get charged $300 just in interest. Since my daughter turned 18, $440 now goes towards my 14 year old son and $435 goes towards back support. If you do the math, only $135 a month goes towards the $50,000. At that rate I'll never pay it off.
Is it legal for the state of California to charge as much interest as a backroom loan shark? Is it possible to have this interest reduced?
BTW... I didn't leave my kids high and dry. I gave my ex-wife free and clear title to our home. Boy what a fool I was! I did it so my kids could continue to live in the house they knew as babies.
Yes, it's legal. But you can apply for relief by filing a modification. You will need to present documentation as to your illness and homelessness and you'll have to make a good case for yourself, including your present intention to pay the child support you owe. There is no statute of limitations on child support so you will be on the hook until your dying day. Go to court and ask for relief. Depending on the judge you get, you may be granted some relief. It's worth a try. Do it ex parte.
