Ok. I'm 22 and my wife is 21. We have been married for just over a year (Sept 17). Neither of us is able to feel affectionate towards the other anymore. She never spends any time with me anymore and constantly complains. I am a full time college student and an Army Reservist. We just bought a house together in June. After buying the house, I bought new appliances for it for her. What will she be entitles to in the divorce? I can't afford an attorney to fight her for anything. Is it possible to come to an agreement on posession of personal property and everything before filing for divorce? I know I would be giving up a lot of things. I am willing to let her keep the house since it is just her name on it along with the appliances if she continues to pay them off. I just want everything of mine. Does anyone have any advice on what to do?
The house and appliances are clearly marital property - doesn't matter whose name they're in if obtained during the marriage. Marital property and marital debt should be split 50-50. If she wants to stay in the house and keep the appliaces she should assume all payments going foward and reimburse you for your half of current equity.
I have had two MI divorces - it is a 50/50 state. If you two can agree then you'll save in attorney fees - but essentially you can take half of the marital property and half of the marital debt, if she wants house make sure everything is refinanced into her name to release your obligation from the debt and have that stated in the divorce papers as something she must do.
