My husband is retiring and has mortgaged the house very high also has about 15,000 in credit card debt. I have no debt and a 14yr old car. 1. Am I responsible for his credit card debt. 2. Am I better off to get a new car now so that will be considered in the judges decision of alimoney. 3. Went for a free consult and got almost no info, just a lot of everything is negotiable answers. im no expert on this, but i can tell you 1st hand that almost all of it is negotiable, whats fare should be the focus- if the CC is a joint account one, then yes, you could be held responsible, i would call them to ask that they remove your name from the account.. (divorce is so complicated) however, i have a similar debt with a joint CC, my xwife paid every month, on time lead to good credit points, my lawyer suggested offering to take that credit card debt, roll it into my refiancing of the house to buy her 1/2 out, to gain the good credit points- i dont think she'll agree to do that, because she has had an account with that credit card co. several years prior to us getting married- which will most likely mean, that we will have to tally up the expenses (itemized) and I pay for what I charged and she pay for hers- another suggestion, my lawyer said that we could file tax returns jointly this year(2006) and apply the entire return to the credicard debt- theres so many angles to think about- whats important though, is both of you work through it in a civil/fair manor-
