Question...Can I move back into my house?

My husband filed for divorce in March...he has temporary custody of our two babies...because I've been living in NH (long story) but the only legal anything that has been done is that he has temporary custody...I have to move back..can I move into the house while he's there...my name is on the mortgage and the deed? My lawyer keeps avoiding answering that question...I just need to know if it's legal.
