My husband said he didn't love me and wants a divorce now. I saw a lawyer and she says I need to state 15 instances of cruel and unusual punishment. I am having trouble with that. Does she mean past instances or current. Refusing sex, with holding financial records are 2 I have come up with. Is there anyone who knows what this means?

Well, we really need more information. How long were you married, are there childre, what are your ages, do you both work? Does the lawyer mean 15 different kinds of this treatment or 15 times that he, for instance, with-held financial info? Weird, I didn't realize there was such a big difference from state to state. Here you don't need any reason at all...

I should have stated 15 instances of cruel and inhuman treatment. I live in New york. Was married 16 years and have 2 children. I have not worked in 10 years because we both decided I should stay home with kids.

NY is a fault state so you must either claim and support fault on the part of one party or live in legal separation for one year before a divorce will be granted.

I can't beleive your lawyer told you that you need to state 15 instances of cruel and inhumane treatment! My ex gave 4 and of those 4 he got ONE! He had to settle for constructive abandonmet. I cut him off from sex for at least a year. I am surprised to hear you need 15 instances. May I suggest you go for the constructive abandonment. Tractormom
