Husband is in jail for molesting our daughter. I want a divorce, but not sure where to start and being a single mom, money is an issue as well. I want to make sure he never has visitation rights. Is this possible? or is there a chance he might get visitation rights? Also, our other child was 7 months old when he went to jail, and hasn't seen him since. (this happened in 2001) He doesn't get out til 2011...I need to know how the courts would handle this type of situation, I have to know for certain that he will never have access to my children, and just basically, where do I start and how much will it cost? Thanx for any help/advice anyone can provide.
Even for being a monster, he does not fully forfit his parental rights so I don't think you can be certain that he'll never have access to his children. In 2011 he could argue that he's rehabilitated and ask for visitation. He may be granted supervised visitation meaning he'd see the children in the safe environment of a child welfare professional's office.
File for a simple divorce with sole custody and no visitation privilidges for the father. Nothing else you do now will affect your options for dealing with this in 2011.
