What are the rules for getting a divorce in NY

Is there a law on how long you have to be seperated before a divoce? How long is the divoce process? Is it just as long as the 2 sides can come to a compromise of the property?

In NY you need to be separated for 1 year unless one of you takes fault for the divorce - i.e. admit or show proof of adultry or other qualifying infraction.

Thank YOu. My stbx wants a divorce and I am trying to think of what reason he is going to give. This ought to be fun! Neither of us had an affair. I guess I will find out soon enough.

There's also "Constructive Abandonment" as a reason fior a divorce, without the year's separation required. If one of you "withholds sex" for a year (and how that gets defined or proven may be the intriguing mystery), then that's grounds for an immediate divorce.

Interesting. My wife withheld for a year and a half, even though she claims that she wanted it.

I have the same question---If there is agreement about property distribution, how long should the divorce process take? AND--can we use ONE lawyer since we agree on everything?
