I am filing for divorce in Missouri and have a few questions about the forms....

1) On the "Statement of Property" & "Statement of Income/ Expense" forms.... this is JUST the petitioner's (my) information, correct? I should not include my husbands personal expenses... just shared?

2) The packet I picked up at my local courthouse included the 2 above mentioned statements, a "Certificate of Dissolution of Marriage" and a "Filing Information Sheet." However, the packet's cover sheet mentioned a "Petition for Dissolution of Marriage" that must be filed with these forms. Can I obtain this document prior to filing the forms in the packet? Is there information on this I will need time to gather?

THANKS A LOT!!

You really need to let your lawyer guide you, but from what I understand....in a marriage there is no separation of personal expenses....so unless he has separate business expenses(and he is a LLC and not a sole proprietor), then all his and your personal expenses are really part of the marriage. I completed mine by listing separately those expenses that are in my name, his name and our name.

For example, if the house is in his name only and so it is his personal expense, well that just doesn't matter....you are still part ownership of that asset(unless the house was owned by him before you got married). The same goes for the expenses, too...I think. If he has run up all the credit cards even though they are in his name only, that could still be considered part of your responsibility....but everything is negotiable, I think.

The statement of income and expenses are just your expenses and income, not his. The statement of property is all the property that you both have. I did use a lawyer and was told that I should. I tried to do it myself but the county courthouse said the judge would probably throw it out and tell me to do it over with a lawyer. Hope that helps.
