My wife and I are at our ends. We are pretty close to making the final decision on Divorce. I can sense it and I want to be prepared 100% before anything happens. She tells me simply "Dont come home" after any argument. In Missouri since the home is in my name can she tell me I am not allowed to come home? There is no abuse, or anything. She just gets angry and tells me I cannot come home. I just want to know the Missouri law on this? And what I can threaten or not threaten? I mean, if I didnt go home, could I call and have everything shut off besides heat (gas) and electric? And can I go to my house, or will I be arrested and removed?
John - I don't know, I'm from Missouri. My ex left the house and I changed the locks. She came and got her stuff when I wasn't there. She can't legally bar you from the home without a court order granting her exclusive rights to the home . You should be wary of a false DV claim if there is any sort of conflict .
