I need help with the rules

I have never been divorced before and my future ex has twice. We were only married for four months and I caught him in a lie about health issues he should have told me about from the time we started dating. I told him I would not ask for anything as long as he payed an amount of money to me each month, and for my health insurance. He doesn't want a divorce and says if I file for one then it's my fault and he is not entiled to give me anything. My question is: I don't have the retainer to hire a lawyer and I wanted to know if I can still file my self and not hire one and what I need to do.

In my experience "pro se" (do it yourself) divorce is only practical if you just want out and only want what you already have, in your own name, in the way of property. Also you cannot have minor kids for this to work.

If your spouse has no problem with this then he simply makes no response to anything and you get a "default" divorce with property treated as I described. If you want court ordered alimony (not as easy in Texas as in some states) and your husband will fight this then you probably need a lawyer, and in Texas the attorney's fees cannot be borrowed or supplied by any third party, to finance a divorce. Nor can an attorney take "family law" cases on contingency. I'm sure you understand that if your health insurance derives from his employment then it will stop as soon as you become divorced, unless you can continue it (at a much higher rate) and there is nothing he can do about this.

From what you have said it sounds like there must be a little more to it than you are willing to talk about.
I hope you can work it out with him instead of divorcing.

Is this because his previously undocumented health issue caused you to now have a health issue (e.g., STD)?

Edit: I'm not asking to "put you on the spot" or anything like that, but mainly because the 1st half of the sentence sounds like since you two were together for 4 months you are somehow entitled to get paid for it, but I don't think that's what you meant.

Hello in Tx. I know of many firms where you can go in for a free initial consultation. Im almost positive that you can find atleast one that is willing to work with you on a payment plan. Dont let lack of money be a deterant to you! There are many out there willing to work with you not against you, just keep your eyes open :-)
