My wife and I are filling for dissolution. We have 2 children which we are both very close with and our relationship is friendly with eachother. We would like to know if I have to pay child support through the state or can we wave that and I pay her on my own as we agree.

It is my understanding that child support is mandated by the courts. You don't have the option of waiving it even if both parties agree. Any money given to the other half is considered a gift, not child support.

I may be mistaken in this matter, so if someone knows something different, please let me know.

Good luck to the both of you.
