Okay, I'm not sure if anyone out there can help me. This is kindof a "technical" question, I guess. Does anyone know if I can change my daughter's last name to mine? As of now, we both have her father's last name and I want to make sure that I have the same last name as her, which is why I didn't change mine in the divorce. We have "joint custody", but I am her residential custodian. Can I change her name to mine without his permission? And at the very least, can I hyphenate it, leaving his on there but adding mine, too? If anyone has an answer, I'd appreciate it.

from my own experience you would have to have permission to change names. However, keep in mind that if you ever remarry your name would again be different. I learned this the hard way, take my advice and let your child keep her fathers name. I ended up naming my child with my maiden name and later had it changed to the biological fathers name.

You can TRY to have her name legally changed , a judge will decide if it's in the child's best interest .

How old is your child? My children were 6,3,& 2 when I received the court order to hyphenate my children's name. I never married their father, therefore they had my last name. He took me to court to get it changed and the judge hyphenated their names. Although I am ecstatic that they also have my last name, it is a pain in the butt having to write their hyphenated name on everything...and if I ever leave his name off a paper, my attorney receives a letter.
