As of right now , you are the unborn child's legal father because marriage creates a presumption of paternity . It is unlikely a divorce would be granted until after the birth . You would have to dis-establish paternity and have your STBX sue the biofather for paternity and CS . Although Idaho does have nofault provisions for divorce , there are also fault grounds that can have an effect on any alimony you might have to pay .
