My wife filed for a divorce last year withdrew her complaint and returned home. After we voulantarly agreed to be separated, I filed for limited divorce and child custody. She failed to answer on time and I filed for Default judgment and I am waiting for decission. In the mean time, my wife changed her attorney; the new attorney filed an answer for my limited divorce complaint. In addition, the new attorney Sent me a supplimnet complaint for absolute divorce based on the last year case which I thought was already withdrawn. I want to know what the rules are for reopenning the case after it was withdrawn. The complaint is not refiled and I was not served. They just filed a suppliment based on the last year case. I am planning to file Motion to dismiss/or strike, but I need to know if there are Rules to support my motion?
