Not legal unless person is informed on the tape. Judge will get mad if person is baited. Spouse will use it agaist you claiming intimidation.

My advice, not legal advice. But tape discreetly and if falsely accused of something or if necessary to call police, they will listen to the tape and be able to tell the truth. Not admissable in court though.
