Hello, My wife and I are divorcing and we would like to proceed in a way that will be easiest and cheapest. We are sort of best friends at this point, and have pretty much already worked out who gets what and how we will deal with our incomes. So, we not only do not need or want litigation, we also probably will not even need mediation which we looked into earlier this year. So far I have filed and served my wife. Our current hurtle is that she is real buzy and cannot file the response soon. So I am holding off on returning the proof of service. Question: What happens if I return proof of survice and she does not respond with in 30 days? I know that after 30 there is a default, but what does that actually mean? Can we then just proceed with changing bank accounts and property titles etc and in 6 months we are not married in the eyes of the law? This way we could save the cost of continuing to file forms at the courthouse, and she would not have to "serve" the response to me. If it were that simple I think more friendly divorces would just forgoe filing the response (F-120). Say it is possible to do what I am hoping as written above, would we be jepardizing our legal recourse in the event financial issues arise in the future? BTW we have no minor children.
