This book will focus on the rights each spouse has under certain laws, situations, and circumstances, and how the division of the property will be decided by the court or through negotiation.
What would you do? I'm in a crunch because stbx isn't paying his truck payments. We both are signers on the loan. Bank keeps calling me asking if I can contact him. Get him to pay. yadda, yadda, yadda. I email him. I text him. No response. He never answers his phone when creditors call, and his voice mailbox is eternally full so they can't leave messages.
I even went so far as to submit a proposal to my lawyer that if I pay the truck off, stbx will lose all rights to my 401K and alimony. However, these types of agreements take time to get into place, and the bank needs to know like tomorrow what we're planning to do. Do I let the truck get repossessed and get that blemish on my credit? (I was basically able to extract myself from everything else that was joint or have responsibility for the payments - which I always make)
We'll need to be refinancing houses and things after this divorce and I'm worried a repossession will make it much harder for me, and result in higher interest rates.
