Let me start by saying that I am not a lawyer and you need one. I am currently separated from my wife, in Virginia, no kids, and we are both in the same general income range, and she cheated on me. So far, everything is very amicable unlike your situation. However, I believe that Virginia is a no fault state when it comes to divorce...in other words, it doesn't matter who was cheating on who as far as the court is concerned. My understanding is that the only thing adultery can get you is a faster divorce, i.e. you don't have to wait the required 6 months (without kids) that you would otherwise have to wait, but you have to be able to prove it. As far as alimony is concerned, I believe it is figured based on a formula and you would have to make 2 times her salary in order to have to pay. As far as abandonment is concerned, that is where you are going to need the lawyer. I don't think it is illegal for her to get into your myspace account or email.
