I am currently in New Hapshire. I've been here for 5 months. My question is about residency laws. I am wanting to take my children back home to Alabama, where I am still a legal resident.

I am wondering if my spouse could file for temporary custody of our children or file for a divorce in New Hampshire even though she isn't a legal resident.

I've read on several websites that filing in another state which you both meet the residency requirements can be done.

Basically, I'm wanting to know if she could file for any kind of legal proceedings here in New Hampshire when we aren't legal residents. Any help on this would be great. Like how long you have to be in New Hampshire to be a legal resident or how long you have to be in New Hampshire to file for divorce. Input needed asap. Thanks.
