My husband lost his job and decided to move to another state. I refused to leave my job and all that is dear and familiar. He did not get a new job. He is going to "pursue a career in real estate". We have been married for 13 years and this is pretty much the only time I have ever stood up to him. He responded by putting the house on the market. People have been coming to look at my house! What do I do? How can I stop him? He was responsible for the mortgage. I don't earn that much.
Whose name is on the deed? If your name is on the deed, he isn't going to be able to sell it without your agreement. If the house was purchased during the marriage, it is a marital asset (even if it is just in his name) and you can get a court order to stop the sale of the house.
The next question is: Can you afford to buy him out of the house? If not, then you will need to sale the house. Again, you need to get a court order that orders the proceeds to be put in escrow while the two of you work out the settlement agreement. Even if he had the house before marriage, some of the equity would be yours (the increase in equity during the marriage).
In other words, you need to file for divorce. That will put a freeze on the assets.
