When to Start Precedings?????

My husband is retiring in 1 year and headed down south where 3 of his kids are, said I could come along but I have my family here and our son. He will not negotiate and after 20 years is ready to head out. I am going to lose my house and have nothing saved and my settlement will be based on his retirement or serve him now??
