I'd just get your friend to pay up to get the thing resolved NOW. He can go pro se and hope for a default judgement, but that may take a while and he'd have to know how to do it all. If there is no property to speak of and they are both wanting the same for the kids, it should be <$1,000 dor a lawyer to do.
