My boyfriend and I have both filed for divorces from our ex's in February 2007. My ex was served in California on March 12th and I just filed a motion for default against him at the courthouse yesterday since he didn't respond within the 20 day period after he was served with the papers. My boyfriend's wife was served in Texas with the papers on March 1st 2007. She hasn't responded at all and a default has been entered on March 22nd 2007. His court date is scheduled for May 22nd 2007 and my court date will most likely be shortly after his. Can our ex's still submit paperwork and be heard ? I mean, there is a 20 day time frame for them to respond and they both let it go by without responding. I think that any response from our ex's after that time frame should automatically be dismissed - reality looks a little bit different though. I know that it is only a "true default" if they don't show up for court. My question is if we are automatically divorced if our ex's don't show up for court? Any input is greatly appreciated !!
