Can a member of the military be sued for divorce while on active duty?

Yes, he or she can be sued for divorce, but he or she enjoys a measure of consideration under SCRA because SCRA protects an active duty member of the armed forces from civil suit, including divorce. A service member is not immune from suit, however. The time periods, or statutes of limitations, affecting the civil actions are either suspended or extended, so that serviceman or woman can devote his or her energies to defense of the country without worrying about civil actions, including divorce.
