Division of Military and Veteranís Disability Benefits Upon Divorce

In Mansell v. Mansell, 490 U.S. 581 (1989), the United States Supreme Court held that federal law prevents state courts from dividing veteranís or military disability benefits under a theory of community property or equitable distribution. Mansell is sometimes interpreted overbroadly, however, and over the years the state courts have developed a number of exceptions to its holding.
