I don’t like my ex-husband’s new boyfriend. Can I get an order saying he can’t be around during visitation?

This is slightly different than the above question. As we noted above in our discussion of homosexuality, the views of judges can vary widely from state to state, city to city, and even court to court. Some judges will restrict visitation to only those times when the homosexual partner will not be present. Some judges will even prohibit overnight visitation if the homosexual partners live together. Other judges will not restrict visitation absent a showing of actual harm to the child(ren). Your lawyer is the best one to advise you on this issue, because he or she will have a perception on how a particular judge may rule.
