If property isn’t divided equally, how is it divided?

Property may be divided equally, especially if you live in a community property state. Even if you live in an equitable distribution state it may be divided equally, if that is the "equitable" thing to do. Most cases that do go to trial or hearing in regards to property division do end up in an equal or close to equal division. Remember this includes marital debt as well as other assets. If there is a joint credit card that has $10,000 of payment outstanding, each spouse is more than likely going to be responsible for $5,000 of it.
