My spouse’s business has a lot of debt. Am I responsible for this debt?

Generally, if your spouse’s business is separate property, he is solely responsible for the debt. It will be allocated to your spouse against your spouse’s assets when the court divides the property.

If the business is held to be marital property, the debt is a marital debt, and you could be responsible. The court could divide the debt the same way it divided the assets or they might do an offset in which you would be ordered to pay off the credit card debt, while your spouse would be responsible for the business debt.
