Should a person consider taxes in contemplation of a divorce?

Tax issues are present in a happy marriage, and so tax issues will be present in a divorce. It is not likely that many people get a divorce because of a tax advantage, or stay married either; but a divorcing couple, particularly a wealthy couple, should be aware of the tax ramifications of all transactions that involve money or property. And for better or worse, divorce, support, and property settlement involves money and property sometimes a lot of money and a misstep in planning often works, not to the benefit of the divorcing spouses, but to the benefit of the U.S. Treasury.

In general, the wealthier the couple are, the more tax questions and issues may come into play in a divorce, but even a merely prosperous middle-class couple who are divorcing should consider the tax implications and tax decisions.
