If you believe that you can work together, and in your situation you may be able to, the court might be amenable to leaving the business in both of your hands, with you and your spouse as business partners. Financially this may be the only option. You may be surprised how often spouses remain business partners after divorce, because it is necessary to make a living to support the child(ren). If dissolving the business would mean financial disaster for everyone involved, the court would even suggest continuing the business relationship if at all possible.
