What if you have a business that you owned before you got married?

A business owned by one spouse before the marriage remains separate property during the marriage. Be aware, however, that if the business increased in value during the marriage, or if both spouses contributed to the business, either by labor or financially, that portion of the value of the business may "inure to the community’s benefit."

If this scenario occurs in a an "equitable distribution state", the spouse would most likely be entitled to half of the value of the business for the period that you were married.
